General Sales Conditions

LaCie.com/ie General Sales Conditions

It is specified in advance that these conditions only apply to sales by LaCie Ltd. of products offered on the site http://www.lacie.com/ie. These conditions apply to the exclusion of all other conditions. These general conditions, along with the order confirmation, constitute the contract between LaCie Ltd. and the customer. The contact may only be amended if LaCie Ltd. agrees to amend it in writing or by email.

CLAUSE 1 - PRICES

1.1 - The prices of our products are indicated in EUR, both including and excluding all taxes, but excluding postage and packing.

1.2 - All orders are payable in EUR.

1.3 - LaCie Ltd. reserves the right to change its prices at any time. However products will be invoiced on the basis of prices in force at the time of making the order, subject to availability on this date.

1.4 - VAT is payable at the current rate. Intra-Community purchases are not permitted on the site http://www.lacie.com/ie.

1.5 - Reservation of title clause: products remain the property of LaCie Ltd. until full receipt of the price by LaCie Ltd.

CLAUSE 2 - ORDERING

To make an order, the customer must be 18 or over, and be contactable on a fixed telephone line. The customer may make an Order:

LaCie Ltd does not accept orders by any methods other than those mentioned above. By submitting an order, the customer makes a purchase offer to LaCie Ltd. LaCie Ltd reserves the right to accept or refuse this offer.

In particular, LaCie Ltd reserves the right to cancel or refuse any order from a customer with whom there is a dispute relative to the payment of an earlier order.

CLAUSE 3 - VALIDATION

If LaCie Ltd accepts the order, LaCie Ltd will notify its acceptance by issuing an order confirmation. The order confirmation will be sent by email to the customer, subject to the customer having indicated an email address. The Order Confirmation will be effective from its date of dispatch. If LaCie Ltd cannot accept the customer's order, LaCie Ltd will attempt to contact the customer by email, telephone or post. The customer declares he has read and accepted these General Sales Conditions before submitting his order. Validation of the order by the customer implies acceptance of these General Sales Conditions

CLAUSE 4 - AVAILABILITY

Our product ranges and prices are valid as long as they are featured on the site, subject to stock availability. Although we make every effort to supply you with the products specified on your order confirmation, we cannot guarantee being able to supply these products if, for example, these products are no longer manufactured, or we are unable to obtain the necessary components.

In such circumstances we will contact you and may suggest an alternative Product that you may wish to purchase. If you do not accept our suggestion, we will cancel your Order for Products that we cannot supply, and we will reimburse you for any sum you may have paid for these Products. Reimbursement of these sums constitutes our sole responsibility to you if we cannot deliver the Products you have ordered.

CLAUSE 5 - DELIVERY

5.1 General Information

Products purchased from http://www.lacie.com/ie can only be delivered to Republic of Ireland. Upon handover of the Products to our carrier we will send you confirmation of dispatch by email, subject to you having indicated an email address. Products are delivered to the delivery address you indicated during the ordering process. In the event of items deliverable on different dates according to their availability, LaCie Ltd. reserves the right to split deliveries. Only products dispatched will then be debited from your account. Postage and packing costs will only be invoiced for one single dispatch. LaCie LTD. will not be held responsible for consequences due to delay in transportation. Any order not dispatched within 30 days will be cancelled, unless stipulated otherwise and specified in the sales offer. Conformity of the goods delivered must be verified at the time of delivery and before signing the carrier's delivery note.

Our carrier specifies a delivery time of 48 hours. Deliveries are generally made in the afternoon. On request we can organise delivery for Saturday morning. In all cases the carrier will contact you (by telephone) or LaCie after two delivery attempts. Delivery is made to your door if you live in a house, or to the bottom of the building if you live in an apartment. As a result you must arrange for your parcel to be brought up to your apartment. Any specific request requires prior consultation with us.

The delivery address must be complete and a telephone number must be indicated. It is also advisable to indicate the entrance hall access code.

5.2 Delivery problems:

You must indicate on the delivery note, in the form of handwritten reservations accompanied by your signature, any anomaly concerning the delivery (damaged product, opened parcel etc.). This verification is considered as made once the purchaser, or a person authorised by the purchaser, has signed the delivery note. These reservations must be sent to LaCie within 48 hours in order that an investigation can be launched.

In the event of delay in delivery in relation to the date indicated in the dispatch mail, we ask you to indicate this delay by telephone or by sending us an email. Once the carrier declares the parcel lost we can send you a replacement product at our cost. If the product(s) ordered are not available at this time, LaCie Ltd will reimburse you for the cost of the products concerned by the carrier's loss. If the product(s) are still available but the price has changed, LaCie Ltd will apply the new sales price.

LaCie Ltd declines all responsibility with regard to extension in delivery times due to the carrier, notably in the event of loss of the products or strike.

5.3 - Conformity of Products

We undertake to refund or exchange products that do not correspond with your order. In this case we would appreciate it if you would send us a detailed statement in writing and return the product(s) to us. LaCie Ltd. will then exchange or refund the product(s). The request must be made within seven days of delivery. Claims made after this time will not be accepted. Products must be returned to us in the condition in which you received them, with all items delivered (accessories, packaging, instructions etc.). In this case your dispatch and return costs will be reimbursed. However, the return costs reimbursed may not exceed 1.5 times the amount of dispatch costs invoiced

The provisions of this clause do not affect your right of withdrawal (satisfaction or refund) specified in clause 7.

CLAUSE 6 - PAYMENT

Payment for your purchase is made by bank card: Visa, MasterCard, credit cards. Your card will not be debited until your order is dispatched. Only payments made with a bank card issues in IRELAND will be accepted.

CLAUSE 7 - SATISFACTION OR REFUND

7.1 - You have 7 days from receipt to return a product that you are not satisfied with. Dispatch and return costs will payable by you. Only the price of the product(s) purchased will be refunded. This right to return will only be accepted for products in their original packaging, which are complete (accessories, instructions etc.), in good condition and accompanied by a copy of the purchase invoice. Items returned incomplete, spoiled, damaged or soiled by the Customer will not be accepted.

7.2 - The right to return does not apply to software, CDs and DVDs with their cellophane wrappers removed by the Customer

CLAUSE 8: RETURNS

In order to exercise your right to return according to the scenarios specified in clauses 5 and 7, you must email us at support.uk@lacie.com to specify the details of the return and to obtain a returns number (RMA).
No return for cash on delivery will be accepted for any reason.
No return will be accepted without a returns number (RMA).

CLAUSE 9 - REFUNDS

Refunds for products according to the scenarios specified in clauses 5 and 8 will be made within two weeks of receipt of the products by us.

Refunds will be made either by crediting your bank account, or by bank cheque in the name of the customer having made the order and sent to the invoicing address. LaCie Ltd decides which method will be used.

CLAUSE 10: SECURITY

Our site incorporates a security system: We have adopted the SSL encrypting procedure, and have also strengthened all scrambling and encrypting procedures, in order to protect all sensitive data linked to the method of payment as effectively as possible.

To protect its customers from any intrusion, LaCie Ltd does not retain bank card numbers on its computer servers. Bank card numbers are processed by SIPS ATOS which sends LaCie Ltd an authorisation number.

CLAUSE 12 - INTELLECTUAL PROPERTY

12.1 - All texts, notes, work, illustrations and pictures reproduced on http://www.lacie.com/uk are reserved by way of copyright and intellectual property, over the whole world. In this way, and in compliance with the measures of the Intellectual Property Code, it is authorised solely for private use subject to the different, even more restrictive, measures of the Intellectual Property Code. Any total or partial reproduction of the LaCie Ltd site is strictly forbidden.

12.2 - some products, such as software, in particular, are the object of specific laws for personal use, regulating copies, public distribution and hire. You must respect the general sales conditions of these products, and LaCie Ltd will not be held responsible for any use which may be made of products in this respect.

CLAUSE 13 - RESPONSIBILITY

The products offered comply with French legislation in force and standards applicable in France. LaCie Ltd will not be held responsible in the event of violation of the legislation of the country to which the product is delivered (for example, in the case of a product ban etc.). It is your responsibility to check with the local authorities the rules for importing or use of the products or services that you plan to order.

LaCie Ltd. may not be held responsible for failure to execute the contract in the event of force majeure, disruption or total or partial strike, particularly of the postal service and transport and/or communications service, flood or fire.

In the event of purchase for a business, LaCie Ltd will not be held responsible for any indirect damages due to this contract, operating loss, loss of profit, loss of opportunity, damages or costs that may arise through the purchase of these products.

You are reminded that it is advisable to back up the data contained in the products purchased. LaCie Ltd will not be held responsible for any loss of data, files or damage defined in the previous paragraph. If it is not possible to use any or some of the products, particularly due to equipment being incompatible, there can be no claims for compensation or refund, and LaCie Ltd will not be held responsible. You will be responsible for ensuring all equipment or software that you order corresponds to your needs and is compatible with your existing systems and practices.

The total responsibility of LaCie Ltd is limited, whatever its basis, to the amount paid by you for the Product(s) and/or Services in question.

CLAUSE 14 - GUARANTEE

Products purchased from http://www.lacie.com/uk come with the guarantee indicated in the item description of the products presented on the site. In order to find out the steps to take concerning after-sales service for any problem or breakdown of a product, you can contact Customer Services at: support.uk@lacie.com. To be able to benefit from the product guarantees, it is essential to retain your receipt for the purchase of the product.

14.1 Guarantee Service

When we repair or replace Computer Equipment pursuant to this guarantee, the Computer Equipment repaired or replaced is guaranteed for the longer of the following guarantee periods: the period of the initial guarantee still left to run, or a period of ninety (90) days from the date of repair or replacement. When Computer Equipment is faulty, we will supply all spare parts and labour necessary for the repair of the Computer Equipment so that it functions normally, in compliance with the provisions of this guarantee. We are not able to provide you with replacement Computer Equipment while your Computer Equipment is being repaired. We will implement all reasonable resources to repair your equipment within fourteen (14) days from notification of the fault; however, repair may take longer due to events beyond our control.

This guarantee only covers your Computer Equipment, not Software. You must refer to your software licenses to find out which guarantees apply.

14.2 Exclusions

The contractual guarantees do not cover:
- replacement of consumables (batteries, bulbs, fuses, aerials, headphones, microphones, wear of recording or reading heads etc.),
- incorrect or non-compliant use of products. We ask you, in this respect, to carefully read the instructions for use provided with the products,
- damage caused by exposing the Computer Equipment to an unsuitable environment (including, without this list being restrictive, excessive temperature or humidity, abnormal physical stress or electrical voltage, insufficient or irregular electrical power, excess light, static electricity or fire),
- breakdown linked to accessories (supply cables etc.),
- faults and their consequences due to a repairer not authorised by LaCie Ltd,
- faults and their consequences linked to usage that does not comply with that for which the product is intended,
- loss or recovery of data,
- any modification to the Computer Equipment required by any legislation entering into force after the date of purchase (the date indicated on your Invoice),
- any Computer Equipment on which the serial number has been erased or altered.

However, you will benefit, if you are an individual, from the statutory guarantee provisions, particularly those relating to the guarantee against hidden defects as defined by clause 4 Paragraph 1 of decree N° 78-464 of March 24th 1978.

CLAUSE 15 - EMAIL ASSISTANCE

15.1 To benefit from technical support and email assistance, you must first register your products on the site http://www.lacie.com/ie

Unless indicated otherwise on the site http://www.lacie.com/ie at the time of your Order, we will provide email assistance, free of charge, for Computer Equipment as defined hereafter, and LaCie Software as defined hereafter, purchased on the site http://www.lacie.com/ie.

15.2 Email assistance will consist of advice and recommendations relating only to problems of installation and commissioning, and to associated problems with usage.

15.3 Email assistance is available between 9am and 6pm on Working Days at the following address: support.uk@lacie.com.

CLAUSE 16 - APPLICABLE LAW - DISPUTES

This contract is subject to UK law. The language of this contract is the English language. Any dispute relative to the interpretation or execution of this and any succeeding document will come under the jurisdiction of the Commercial Court of Evry.

CLAUSE 17 - PERSONAL INFORMATION

LaCie Ltd agrees not to divulge to third parties the information you communicate to us. This information is confidential. It will only be used to process your order and to reinforce and personalise communication and the product range reserved for customers of LaCie Ltd, notably by information mails from LaCie to which you may be subscribed, and as part of the personalisation of the site according to your areas of interest. However, when you link to http://www.lacie.com/uk from some sites of partners of LaCie Ltd, identified as such, the data concerning you may, in particular instances, be communicated to them. If you do not want this, you can notify us via the addresses below. To find out the information they have stored concerning you, visit the partner site in question. Our site is also designed to be particularly attentive to our customers' needs. For this reason, among others, we use cookies. A cookie has the aim of notifying us of your visit to our site.
